Appellate trials are not a retrial of the case with all the witnesses and presentation of factual evidence. Appeals focus on whether the judge appropriately applied the law with regard to ruling on motions, instructing the jury, and excluding improper evidence. While trying a case we always make an effort to preserve arguments in the trial record supporting our client’s side so the necessary documentation will appear if the case is appealed. Although only a small proportion of cases progress to the appeals court, we are willing to challenge the opposition’s position at that level if that is what our client directs.
